General Terms and Conditions – Nic Services

Welcome to Nic Services! By accessing our website and utilizing our services, you agree to comply with the following Terms and Conditions. Please read them carefully before engaging with our services.

 

 

 

1. Definitions

 

 

  • Client: The natural person or legal entity engaging Nic Services for event planning, marketing consultancy, or travel planning services.

  • Services: The event planning, marketing consultancy, and travel planning services offered by Nic Services.

  • Agreement: The contract between Nic Services and the Client for the provision of Services, including these Terms and Conditions.

 

 

 

 

2. Applicability

 

 

2.1 These General Terms and Conditions apply to all offers, agreements, and services provided by Nic Services, unless otherwise agreed upon in writing.

 

2.2 Deviations from these Terms and Conditions are only valid if expressly agreed upon in writing by both parties.

 

2.3 In the event that any provision of these Terms and Conditions is found to be unenforceable or invalid under Curaçao law, the remaining provisions shall remain in full force and effect.

 

 

 

3. Services

 

 

3.1 Nic Services offers the following:

 

  • Event Planning & Management: Organizing and coordinating corporate and private events.

  • Marketing & Branding Consultancy: Providing strategic marketing and branding solutions.

  • Travel Planning & Ticket Booking: Assisting with flight and accommodation arrangements.

 

 

3.2 Nic Services will execute the Services to the best of its ability and in accordance with the Agreement.

 

 

 

4. Formation of Agreement

 

 

4.1 An Agreement is established when the Client accepts a written offer from Nic Services or when Nic Services confirms an assignment from the Client in writing.

 

4.2 All offers from Nic Services are non-binding and subject to availability.

 

 

 

5. Client Obligations

 

 

5.1 The Client shall provide all necessary information and cooperation required for the proper execution of the Services.

 

5.2 The Client guarantees that the information provided is accurate and complete.

 

5.3 The Client shall adhere to agreed-upon deadlines for the provision of information and approvals.

 

 

 

6. Fees and Payment

 

 

6.1 Fees for Services are specified in the Agreement or accompanying proposal.

 

6.2 A non-refundable down payment of 50%  is required upon acceptance of the Agreement.

 

6.3 The remaining balance shall be paid in accordance with the payment schedule outlined in the Agreement.

 

6.4 Payments must be made via Bank transfer to the account specified by Nic Services on the invoice.

 

6.5 In the event of late payment, Nic Services reserves the right to suspend or terminate the Services until payment is received.

 

 

 

7. Cancellation and Termination

 

 

7.1 The Client may cancel the Agreement in writing. Depending on the timing of the cancellation, the Client may be liable for certain fees as outlined below:

 

  • Cancellations made more than 30 days before the event/service date: 60% payment is required unless agreed different in writing.

  • Cancellations made less than 30 days before the event/service date:  100% payment is required unless agreed different in writing.

 

 

7.2 Nic Services may terminate the Agreement if the Client fails to meet their obligations under these Terms and Conditions.

 

 

 

8. Liability

 

 

8.1 Nic Services shall perform the Services to the best of its ability but does not guarantee specific results.

 

8.2 Nic Services is not liable for indirect or consequential damages arising from the use of our Services.

 

8.3 Any liability of Nic Services is limited to the amount paid by the Client for the specific Service that gave rise to the liability.

 

 

 

9. Force Majeure

 

 

9.1 Nic Services is not liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, governmental actions, or labor strikes.

 

 

 

10. Governing Law and Jurisdiction

 

 

10.1 These Terms and Conditions are governed by the laws of Curaçao.

 

10.2 Any disputes arising from or related to these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of Curaçao.

 

 

 

11. Amendments

 

 

11.1 Nic Services reserves the right to amend these Terms and Conditions. Clients will be notified of any changes in writing or via our website. Continued use of our Services after such amendments constitutes acceptance of the new Terms and Conditions.
